Legal
These terms explain how bookings, payment and cancellations work, and what applies on board. Every charter is also confirmed by its own written charter agreement.
01About these terms
These terms apply to every charter arranged with Aino Yachts. Aino Yachts is operated and owned by Castech Ltd. In these terms, “we” and “us” mean Castech Ltd, and “you” means the person who books the charter, together with the guests they bring on board.
Every booking is confirmed by a separate written charter agreement. It sets out the details of your charter, including the deposit, the payment schedule, the APA where applicable, cancellation and weather. If anything in the charter agreement differs from this page, the charter agreement prevails.
02Bookings
You can enquire through “Plan your charter” or by contacting us directly. We reply to every enquiry within 24 hours. A proposal or quotation is not a booking.
A charter is confirmed once the charter agreement has been signed and the deposit stated in it has been received. The person who signs the agreement must be at least 18 years old and accepts these terms on behalf of all guests.
All our charters are day charters. There are no overnight stays on any of our boats.
- Sunseeker Ocean 90ft M/Y AINO: full day. A charter week is five days on board, at €100,000 including VAT and fuel for 150 nautical miles.
- Manhattan 73ft: full day only.
- Axopar 37ft: full or half day, and transfers.
- Donzi 28ft: with a captain; price on request.
Longer charters can be arranged on request. A private chef needs advance notice; the earlier we know, the better. Before your charter, we may ask for the names of your guests and any other details the crew or the port authorities need.
03Payment and APA
The charter rate is the total charter price. It includes fuel for up to 30 nautical miles of cruising, still and sparkling water, light snacks, the full crew and the equipment on board; weekly charters on M/Y AINO (5 days, VAT included) include fuel for 150 nautical miles.
A deposit is due when you sign the charter agreement. The balance is due as stated in the agreement, which also sets out the accepted payment methods.
Where applicable, extras such as fuel beyond the included nautical miles, food, drinks and berthing are covered by an Advance Provisioning Allowance (APA), paid before the charter. You receive a full account afterwards, and any unused balance is returned.
04Cancellations and changes
If you need to cancel or change your charter, please tell us as early as possible and in writing. Cancellation charges and changes to dates are as set out in your charter agreement. We will always try to find another date, subject to availability.
The captain is responsible for the safety of the vessel and everyone on board. His or her decision on weather, sea conditions, routes and anchorages is final. The captain may change the route, shorten the day or decide that the charter cannot go ahead.
If a charter is cancelled for weather or safety reasons, it will be rescheduled or refunded as set out in your charter agreement.
05On board
The captain has authority over the vessel at all times, and guests are asked to follow the crew’s instructions, particularly on safety.
- The number of guests may never exceed the licensed capacity of the vessel.
- Illegal substances are not permitted on board. The captain may refuse boarding to, or end the charter for, anyone whose behaviour puts the vessel, the crew or other guests at risk, or breaks the law.
- Children are welcome and must be supervised by a parent or responsible adult at all times, on board and in the water.
- Water toys are used at the crew’s discretion and only when conditions are safe. The jet ski may only be driven by a guest who holds a valid licence.
- Please let us know before your charter about any medical condition, mobility need or allergy the crew should be aware of.
- Guests are responsible for any loss or damage they cause to the vessel or its equipment, beyond normal wear.
06Liability and insurance
Our vessels are insured as required by law. Guests’ personal belongings are brought on board at their own risk. We recommend that you and your guests hold suitable travel insurance.
We are not responsible for delays or changes caused by events beyond our reasonable control, such as weather, sea conditions or decisions of port and maritime authorities.
Nothing in these terms or in the charter agreement limits or excludes any liability that cannot be limited or excluded by law.
07Governing law
These terms and every charter agreement are governed by the laws of Malta, and the courts of Malta have jurisdiction, unless the mandatory consumer law of your country of residence provides otherwise.
